Sumario:The protection action was stablished under the Ecuadorian Constitution of 2008 in order to protect people’s constitutional rights. This action can be submitted when there is an infringement of rights by an act or an omission of a public institution or any citizen under certain situations. However, there is another requirement stablish by the law; it is that the protection action cannot be presented if the act of the public institution can be appealed in the ordinary judges, who review the violation of the law. Consequently, the decision number 210-15-SEP-CC of the Constitutional Court ruled that the unilateral termination of a contract cannot be appealed in the constitutional justice because it can be appealed in the legal justice. Therefore, this analysis pursues the understanding of the appealing of the unilateral termination of a contract and if it can be appealed in the constitutional justice by using the jurisprudence of the Constitutional Court.
