The Ecuador currently suffer from this vulnerability, lack of implementation of the rights specified in the Constitution and international treaties, but we have a standard full compliance with the law is still lacking. New legal concepts in family law seek to provide protection to new types of families, these no-fault divorce and the regulatory agreement, which figures on the right to privacy and autonomy of the parties is weighted as for his family and personal relationships. The no-fault divorce, seeking full compliance with the right to privacy that is in our Constitution and in international treaties to which Ecuador has ratified, this right is violated by maintaining a divorce cases in which they must prove guilt one of the spouses or failure of a marriage duty, also the will of the spouses is violated because it is necessary to have to resort to a cause in order to access the process. The Settlement Agreement is a document which seeks to prevail bargaining power of the parties to regulate the family situation after divorce proceedings, it is necessary to prime the autonomy of the spouses but is respected as it stipulated in the standard especially in the item on children and adolescents. The implementation of this legal concept has been socially relevant because it seeks to separate the marital relationship with the parental relationship and carried out better relationship after a divorce. Both figures have been renovated in legislation closer to our countries have supported its implementation in the previously mentioned rights and the need to comply with international human rights law, these modern reforms have to be given a constitutionalization of law which is the same family need in our country.

El Derecho de Familia, perteneciente al Derecho Civil, regula las relaciones y vínculos que pueden surgir de los diferentes tipos de familias que nacen, existen y se modifican según el avance de la sociedad, a todos estos vínculos hay que brindarles protección. El Ecuador actualmente sufre de esta desprotección, por la falta de la aplicación de los derechos especificados en la Constitución y Tratados Internacionales, tenemos la norma pero el cumplimiento pleno del derecho aun es escaso. Nuevas figuras jurídicas en el Derecho de Familia buscan brindar protección a los nuevos tipos de familias, estas son el divorcio sin causa y el convenio regulador, figuras en las cuales se pondera el derecho a la intimidad y la autonomía de la voluntad de los contrayentes en cuanto a sus relaciones familiares y personales. El divorcio sin causa, busca el cumplimiento pleno del derecho de intimidad que se encuentra en nuestra Constitución y en Tratados Internacionales a los cuales el Ecuador se ha ratificado, este derecho es violado al mantener un divorcio con causales en las que se debe probar la culpabilidad de uno de los consortes o el incumplimiento de algún deber matrimonial, así mismo se viola la voluntad de los cónyuges porque es necesario tener que recurrir a una causa para poder acceder al proceso. El convenio regulador, es un documento en el cual se busca que predomine la capacidad de negociación de los cónyuges para regular la situación familiar después de un proceso de divorcio, es necesario que prime la autonomía de la voluntad de los consortes pero que se respete lo que se estipula en la norma sobre todo en el tema relativo a niños, niñas y adolescentes. La implementación de esta figura jurídica ha sido de relevancia social pues busca separar la relación conyugal con la relación parental y que se lleven a cabo de mejor manera la relación después de un proceso de divorcio.
