For this we will mention the jurisdictional guarantees that are in the new constitution in order to know The Action for its failure to comply with it in depth. We will also mention the Human Rights established for humankind and we will compare them with our constitutional Rights. It will be analyzed why the Human Rights are inside the juridical regulations of the states. We will analyze the Basic Concepts of jurisdictional guarantees, the right to jurisdiction, and the legal authority to act. We will talk about our present constitution, where it comes from, and what it was made for. When analyzing the failure to comply with the law, we will revise who can present an action or being the legitimate main object of action before the institution which he or she comes from, as well as, the paper work and the sentence given. El presente Trabajo de Titilación consiste en conocer qué responsabilidad existe al no acatar una sentencia constitucional dentro del marco jurídico actual; para esto mencionaremos las garantías jurisdiccionales contemplados por nuestra Constitución y conoceremos a profundidad la Acción por Incumplimiento. Se hará mención sobre los derechos humanos consagrados a nivel mundial y su comparación con los derechos constitucionales, analizando el por qué los derechos humanos son reconocidos por los ordenamientos jurídicos de los Estados. Analizaremos conceptos básicos de las garantías jurisdiccionales, el derecho a la jurisdicción, titularidad para accionar, hablaremos sobre nuestra Constitución, de dónde procede y la finalidad para la que fue creada.
