We will observe the social impact of untimely dismissal for a family father during the use of his paternity leave, which at legislative level has represented an achievement since it is not only a benefit for the employee but for the family Since it can count on the father in the delivery and postpartum. By means of the specific study of each one of the legal figures and comparing the same we will analyze which is correct to proceed with this to suggest the appropriate administrative procedure in case of situations similar to those of the reagent. El siguiente trabajo tiene como finalidad realizar un análisis del La confrontación de dos licencias que por una mala interpretación de la ley resultan en un despido intempestivo, al momento de que el trabajador hace uso de su licencia por paternidad dos días antes de expirar su licencia por accidente laboral. Observaremos la incidencia social que trae consigo el despido intempestivo para un padre de familia, durante el uso de su permiso por paternidad, lo cual a nivel legislativo ha representado un logro ya que no se trata únicamente de un beneficio para el empleado sino para la familia ya que puede contar con el padre en el parto y posparto.
