Sumario:Water is one of the most important and valued element of nature. It is considered a non-renewable resource therefore it is inalienable, imprescriptible, and non-confiscable. In other words, it is an indeclinable human right. Water is property of the State and its use is regulated, administered, and controlled in order to provide a better quality of life to everyone. The manner in which water is distributed could lead to great social conflict. In Ecuador, water is granted to all natural and legal entities by means of concessions, a proceeding that must meet certain established requisites. An analysis of current concessions shows that these have been performed through legal procedures and following predetermined formalities. If the Constitution of 1998 and the current Constitution are compared, it can be seen that the present one treats water in a more special and extensive way due to rapid population growth and other internal and external factors occurring internationally, taking into consideration the impact of this resource on health, diet, production, and the environment. The way in which the State administers, controls, and extends the usage of water will be imperative and according to the new project of Water Law, this process will no longer be conducted though concessions; permissions will be implemented instead. It is also important to correct the mode water is currently utilized in order to make the most out of this resource; more infrastructure is definitely needed to prevent its waste and contamination.
