Especially restricting the international standards indicated by the Inter-American Commission on Human Rights IACHR and the Inter-American Court of Human Rights I / A Court HR in relation to that the judicial resources are fast, simple and effective. These restrictions that break with the principles and principles that the Constitution of the Republic, and imposed by the Organic Law of Jurisdictional Guarantees, will constitute the fundamental problem to be developed in this work. Con la vigencia de la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional, y concretamente en relación a la Acción de Protección prevista en su artículo 42, se plantean varias restricciones, convirtiendo a ésta en una garantía jurisdiccional “subsidiaria”; es decir, que solo cabe ser activada cuando se hayan agotado otros mecanismos previos y eficaces contemplados en el ordenamiento jurídico, limitando el objetivo fundamental que nos plantea el referido artículo 88 de la Constitución; es decir como una verdadera herramienta de defensa directa de los derechos. Especialmente restringiendo los estándares internacionales señalados por la Comisión Interamericana de Derechos Humanos CIDH y la Corte Interamericana de Derechos Humanos Corte IDH en relación a que los recursos judiciales sean rápidos, sencillos y efectivos.
