And we formulate the problem through a guiding question How encouraging that the guarantees normed in the Code of Criminal Integral and the Constitution, for drivers who cause traffic accidents are the result of the irresponsibility of pedestrians are met? The study investigated theme allows hypothesize or idea to defend Reforming the Art 377 of the Code of Criminal Integral, could have a better control mechanism to ensure drivers when a traffic accident caused by a pedestrian happen. Recommend a bill reformatory to Article 377 of the COIP guaranteeing them rights that causes a traff ic accident resulting in death when he avoid hitting a pedestrian or avoid him for disrespecting traffic rules and recommended added to Art is prepared 377 of the Code Integral Penal a clause that says "is exencionara of guilt when the driver is involved in a traffic accident because of the disrespect of the law by the pedestrian or to avoid hitting him him, makes maneuvers that causes death pedestrian or third party liabilities in circulation "……. La presente investigación trata sobre las falta de garantías legales y constitucionales para los conductores involucrados en accidentes de tránsito con resultados de muerte producidos por la irresponsabilidad del peatón. Lo que pretendemos lo plasmamos con el objetivo de analizar la tipificación en el Código Orgánico Integral Penal de muerte cul posa y los mecanismos de aplicación de las garantías para conductores ante accidentes ocasionados por irresponsabilidad del peatón. Y formulamos el problema a través de una pregunta rectora ¿Cómo propiciar que se cumplan las garantías normadas en el Código Orgánico Integral Penal y la Constitución, para los conductores que ocasionen accidentes de tránsito que son consecuencia de la irresponsabilidad del peatón? El estudio del tema investigado permite plantear la Hipótesis o idea a defender Reformando el Art 377 del Código Orgánico Integral Penal, se podría tener un mejor mecanismo de control al garantizar a los conductores cuando suceda un accidente de tránsito ocasionados por un peatón. Recomendar se elabore un anteproyecto de ley reformatorio al Art 377 del COIP garantizándolos derechos del que ocasione un accidente de tránsito con resultado de muerte cuando este se dio por evitar atropellar a un peatón o esquivarlo por irrespetar las normas de tránsito y se recomienda agrega al Art 377 del Código Orgánico Integral Penal un inciso que diga “se exencionara de culpa cuando el conductor se ve involucrado en un accidente de tránsito por culpa del irrespeto de la ley por parte del peatón o al eludir atropellarlo a él, hace maniobras que ocasiona la muerte del peatón o terceros pasivos en la circulación”…… 2016-07-14T22:07:45Z 2016-07-14T22:07:45Z 2016 bachelorThesis Lozano Lavayen, Jorge Lorenzo; Ocaña Carranco, Christopher Adolfo (2016).
