This action can be submitted when there is an infringement of rights by an act or an omission of a public institution or any citizen under certain situations. However, there is another requirement stablish by the law; it is that the protection action cannot be presented if the act of the public institution can be appealed in the ordinary judges, who review the violation of the law. Consequently, the decision number 210-15-SEP-CC of the Constitutional Court ruled that the unilateral termination of a contract cannot be appealed in the constitutional justice because it can be appealed in the legal justice. Therefore, this analysis pursues the understanding of the appealing of the unilateral termination of a contract and if it can be appealed in the constitutional justice by using the jurisprudence of the Constitutional Court. La acción de protección fue establecida en la Constitución de 2008 como un mecanismo para la tutela de derechos constitucionales cuando existe vulneración a los mismos. Como requisitos, a nivel constitucional, está la vulneración a derechos por un acto u omisión de autoridades públicas no judiciales o de particulares en determinadas situaciones. El desarrollo principalmente legal de esta garantía ha establecido un requisito adicional, que se refiere a que el acto que puede vulnerar derechos no sea impugnable por vía contenciosa administrativa o que no exista ninguna vía adecuada para proteger los derechos. Con estos antecedentes, se resuelve la sentencia No. 210-15-SEP-CC, en donde la Corte Constitucional consideró que, frente a la terminación unilateral del contrato, no se puede interponer una acción de protección puesto que esta es impugnable por la vía contenciosaadministrativa.
